This website is the website for Your Tiny Home Co. Pty Ltd T/A Your Tiny Home Co. (A.C.N. 687 987 579) (Your Tiny Home, we, us, or our).
Please take the time to read these Terms and Conditions that are applicable to the use of this Site and the content made available to you (Terms). These Terms together with our Privacy Policy are very important as they apply to, and are binding upon all Site visitors, clients, customers, and all other users of the Site (“user”, “you” and “your”).
In addition, upon registration of a membership by a Site visitor, client or customer, all members are bound by the Terms, Privacy Policy, Member Terms and Conditions and Giveaway Terms and Conditions.
Preliminary Disclaimer
Any giveaway, contest or promotion run by Your Tiny Home is solely limited to residents of:
- Queensland; and
- New South Wales – Permit Number TP/04706; and
- Victoria.
(Exclusive Locations)
Your Tiny Home may, from time to time, seek to extend the giveaway area upon obtaining the appropriate permits, applications or notifications for the respective states within Australia.
Until such time as the appropriate permits are obtained, Your Tiny Home expressly reserves their right to disqualify or remove any member or participant who does not reside within the Exclusive Locations.
GOVERNING LAW AND JURISDICTION
By using the Site, you accept these Terms in full, including any modifications by Your Tiny Home from time to time.
If you register, or use an online form, contact us, or contract services from the Site or purchase a product from the Site, then you expressly agree to these Terms, including any modifications by Your Tiny Home from time to time.
Our Site, like any other website, is accessible to anyone, which means, it may be accessed throughout Australia and overseas. We make no representation that our Site complies with the laws (including intellectual property laws) of any country outside Australia. If you access our Site from outside Australia, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our Site.
All Terms shall be construed in accordance with and governed in all respects by the laws of the State of Queensland, Australia. In relation to any dispute, we ask that you contact us in the first instance so that both parties can, acting in good faith, resolve the dispute to our mutual satisfaction as quickly, cost effectively and efficiently as possible. Where a dispute cannot be resolved, you agree to submit to the non-exclusive jurisdiction of the courts of the State of Queensland, Australia.
CONSENT TO SITE TERMS OF USE
By accessing and using this Site, our social media channels and any other materials made available to you, purchasing products or services or registering as a member (Online Services) provided on this Site, whether made available for purchase or not, you are taken to accept our Terms in full, including any modifications by Your Tiny Home from time to time.
By using the Site, accessing or purchasing any Online Services, you warrant that:
- you are over 18 years of age and have the legal capacity to enter into a legally binding contract;
- have read and accepted these Terms; and
- will comply with these Terms.

Ownership of Intellectual Property
The Site and Online Services contain intellectual property owned by Your Tiny Home and by third parties that license the content to us (Third-Party Licensed Intellectual Property), including, without limitation, trademarks, copyrights, proprietary information, designs, patents and other intellectual property rights, as well as the business name, logo, all designs, text, videos, audio files, graphics, other files, and software (Content). Your use of the Site, the Online Services and access to any Content does not grant or transfer any rights, title or interest to you in relation to this Site, the Online Services or the Content.
No Commercial Use
You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever the Site, Content or the Online Services, Your Tiny Home’s Intellectual Property and Third-Party Licensed Intellectual Property in whole or in part without our prior written consent. We reserve the right to immediately remove your access to our Site and Online Services, without refund, if you are found to be violating these Terms.
LINKS TO OTHER WEBSITES
Our Site and social media channels may have links to other sites operated by third parties. Unless we expressly tell you otherwise, we do not in any way, endorse, control or approve of and nor are we responsible for the content on those websites. It’s up to you to decide if those websites and their content work for you, and we recommend that you investigate and do your homework to find that out.

Data Collection and Use
By using the Site and Online Services, you acknowledge and agree that:
- Your Tiny Home collects, uses, and discloses your personal information in accordance with our Privacy Policy;
- Your Tiny Home may share your purchase information, contact details, and transaction history with Partners when you access Partner Offers for the purposes of fulfilment, customer service, and marketing;
- Partners are independent data controllers, and their use of your personal information is governed by their own privacy policies;
- Your Tiny Home may use your information to send you marketing communications about Platform features, Partner Offers, contests, and promotions (you may opt-out at any time);
- Your Tiny Home uses cookies and similar technologies as described in our Privacy Policy; and
- You are responsible for maintaining the accuracy of your personal information.
Data Security
While we implement reasonable security measures to protect your personal information, you acknowledge that:
- no method of electronic transmission or storage is 100% secure;
- we cannot guarantee absolute security of your information;
- you are responsible for maintaining the confidentiality of your account credentials; and
- you must notify us immediately of any suspected unauthorised access to your account.
Data Breach Notification
In the event of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Privacy Act 1988 (Cth).

DESCRIPTIONS OF ONLINE SERVICES
Our Business Model
Your Tiny Home operates a membership-based platform (Platform) that provides:
- access to exclusive discounts and offers from registered Australian retail partners (Partner Offers);
- free entry into giveaways for members;
- a marketplace where members can browse and access Partner Offers; and
- loyalty rewards and benefits based on membership tier and duration.
Member Dashboard Access
Members shall be granted access to a member dashboard through which they may:
- view and access available discount offers based upon their selected membership tier;
- manage payment methods and billing arrangements in accordance with their selected membership package;
- update account information and personal details as required;
- track loyalty rewards and giveaway entries;
- view purchase history and active offers; and
- manage communication preferences.
Platform Functionality
- Partner Offers are provided by independent third-party businesses (Partners) who have registered with Your Tiny Home;
- Your Tiny Home facilitates the connection between members and Partners but does not sell, supply, or fulfil products or services offered by Partners;
- When you access a Partner Offer, you will be directed to complete your transaction directly with the Partner;
- Your Tiny Home may receive commission or fees from Partners for facilitating member access to Partner Offers; and
- The availability, pricing, and terms of Partner Offers are determined by the respective Partner and may change without notice to Your Tiny Home.
Service Modifications
Your Tiny Home expressly reserves the right, in its sole and absolute discretion and without prior notice or liability, to:
- add, modify, change, suspend, or discontinue any portion of the Online Services, or features at any time;
- add or remove Partners and Partner Offers from the Platform;
- impose limitations on any aspect of the Online Services;
- restrict or cancel user access to any portion or the entirety of the Site; and
- alter these Terms governing use of the Site or Online Services.
Your access to and use of the Site and the Online Services, including any new services or features introduced through the Site, shall remain subject to and governed by these Terms, as amended from time to time.
Accuracy of Information
We try to be clear and informative when describing our Online Services and do our best to describe and display them as accurately as possible in a way that is easy to understand.
Whilst we do try our best, occasionally there may be information that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers and availability.
From time to time, we may amend errors in pricing and descriptions. We reserve the right to refuse or cancel any order or membership if any information on the Site (including our Online Services) is inaccurate at any time without prior written notice (including after you have submitted your order).
MEMBERSHIP PACKAGES
Available Membership Options
Your Tiny Home offers the following membership options:
- One-Time Access Package: A single payment providing access to the Platform and Partner Offers for a specified period (details available at www.yourtinyhomeco.com/memberships/ );
- Monthly Loyalty Membership: A recurring monthly subscription providing ongoing access to the Platform, Partner Offers, and additional loyalty benefits (details available at www.yourtinyhomeco.com/memberships/ ); and

Membership Benefits
Benefits vary by membership tier and may include:
- access to Partner Offers and discounts;
- entries into free promotional giveaways and contests;
- loyalty rewards and bonus entries based on membership duration;
- exclusive access to limited-time offers; and
- priority customer support.
Specific benefits are detailed on the membership information page and may change at Your Tiny Home’s discretion.
Loyalty Streak
For Monthly Loyalty Members:
- a “loyalty streak” tracks consecutive months of active membership;
- longer loyalty streaks may provide additional benefits including bonus giveaway entries;
- your loyalty streak is maintained only while your membership remains active, and payments are current;
- if your membership is cancelled or payments fail, your loyalty streak will be lost; and
- loyalty streaks cannot be reinstated after cancellation except as specified in the Termination section below.
PRICES AND PAYMENT
Pricing
- All prices are displayed in Australian Dollars (AUD) and are inclusive of Australian Goods and Services Tax (GST) where applicable;
- Prices for Online Services are as displayed on the Site at the time of purchase;
- Prices may change at any time without advance notice to you;
- Once you have completed a purchase, you will be charged the price displayed at the time your order was validated and accepted by us; and
- Partner Offer prices are set by Partners and may differ from prices advertised on Partner websites.
Payment Methods
We accept payment for Online Services through the following methods:
- Credit card (Visa, Mastercard, American Express);
- Debit card;
- PayPal; and
- Such other payment methods as we may notify from time to time.
All payments are processed securely through third-party payment processors. We do not store your complete credit card details on our servers.
Payment Terms
You acknowledge and agree that:
- you must make timely and full payments for all Online Services purchased;
- you have the necessary rights and authority to use the payment method provided;
- you will maintain current and accurate billing information at all times;
- you authorise Your Tiny Home to charge the payment method on file for all amounts owed;
- you are responsible for all charges incurred through your account, including unauthorised charges if you failed to properly secure your account;
- payment is due immediately unless otherwise specified; and
- you must notify us immediately of any changes to your payment method.
Recurring Payments for Loyalty Memberships
If you subscribe to a Monthly Loyalty Membership:
- you authorise Your Tiny Home to automatically charge your payment method on a recurring monthly basis;
- charges will occur on or around the same day each month as your initial subscription date;
- you will receive email notification prior to each billing cycle;
- you are responsible for ensuring sufficient funds are available;
- recurring charges will continue until you cancel your membership; and
- cancellation must be completed before the next billing date to avoid charges for the following month.
Failed Payments
If a payment is declined or fails for any reason:
- we will make up to four (4) automatic billing attempts;
- billing attempts will occur every seven (7) days, providing a total grace period of twenty-one (21) days;
- you will receive email notification of each failed payment attempt;
- you may manually update your payment information and retry payment during the grace period;
- if the fourth and final attempt fails, your membership will be automatically cancelled and any loyalty streak will be lost;
- we may suspend your access to Online Services immediately upon initial payment failure; and
- the system allows a maximum of four attempts in total, including any manual retry attempts you initiate.
Payment Processor Terms
When making payments, you acknowledge that:
- you have read and agree to the terms and conditions of our third-party payment processors;
- payment processor terms are available on their respective websites;
- disputes regarding payment processing must be directed to the relevant payment processor;
- payment processing fees (such as international transaction fees) may apply and are your responsibility; and
- refunds, if approved, will be processed through the original payment method and may take 5-10 business days to appear in your account.
Disputed Charges
If you dispute a charge:
- you must contact us within fourteen (14) days of the charge;
- we will investigate all legitimate disputes;
- disputed charges do not relieve you of payment obligations unless the dispute is resolved in your favour;
- initiating a chargeback without first contacting us may result in immediate account suspension; and
- fraudulent chargebacks may result in permanent account termination and legal action.
REFUNDS
All membership packages, loyalty memberships, and products or Online Purchases purchased during a promotional period or giveaway are non-refundable.
Our Online Services come with guarantees that cannot be excluded under the Australian Consumer Law.
- For major failures with services, you are entitled to:
- cancel your service contract with us; and
- receive a refund for the unused portion or compensation for its reduced value.
- For major failures with goods (or Online Services), you are entitled to choose a refund or replacement.
- If a failure with the goods or service does not amount to a major failure, you are entitled to:
- have the failure rectified within a reasonable time; or
- if rectification is not completed within a reasonable time, a refund for the goods and cancellation of the service contract.
Refunds or rectifications cannot be provided for reasons including, but not limited to:
- change of mind;
- failure to follow instructions; or
- failure to properly understand the product or service (incl. Online Services).
How to Request a Refund
To request a refund under the Australian Consumer Law:
- contact us at info@yourtinyhomeco.com or through the contact form at http://www.yourtinyhomeco.com/contact;
- provide your account details, purchase information, and details of the failure;
- we will respond within five (5) business days;
- we may request additional information or evidence;
- if your refund is approved, it will be processed within ten (10) business days; and
- refunds will be issued to the original payment method.
Partner Product Refunds
- Your Tiny Home is not responsible for refunds relating to products or services purchased from Partners;
- All refund requests for Partner products must be directed to the relevant Partner;
- Partners have their own refund policies which you must review before purchase;
- Your Tiny Home cannot compel Partners to issue refunds; and
- If you have a dispute with a Partner, you may report it to us at info@yourtinyhomeco.com and we will consider whether to continue our Partnership with the business.
External Dispute Resolution
If you are not satisfied with our response to your refund request, you may contact:
- Your local Office of Fair Trading or Consumer Affairs;
- The Australian Competition and Consumer Commission (ACCC); or
- An external dispute resolution scheme if we are a member of one.
ACCOUNT REGISTRATION AND ELIGIBILITY
To use certain portions of the Site and Service, you will be required to register on the Site and create a user profile or account (Account). Eligibility is limited to persons aged 18 years or over.
As part of the registration process, you may be required to submit your name, address, email address, and similar information, and to select a password (Registration Information).
You agree that:
- all Registration Information provided shall be true, accurate, current, and complete;
- failure to provide such information shall constitute a breach of these terms and conditions and may result in immediate termination of your Account;
- you shall promptly update your Registration Information to maintain its accuracy and completeness; and
- you shall maintain the confidentiality of your password.
In creating an Account, you shall not:
- select or use the email address or username of another person with the intent to impersonate that person;
- use a name subject to the rights of any other person without authorisation;
- use an email address or username that is profane, offensive, or otherwise inappropriate; or
- allow any other party to use your Account or password except as expressly permitted herein.
You may not share or transfer any Account. You may not disclose your password to anyone. You agree to immediately notify Your Tiny Home by email to info@yourtinyhome.com of any known or suspected:
- unauthorised use of your Account; or
- breach of security, including loss, theft, or unauthorised disclosure of your password.
You understand and agree that you shall be liable for all activities that occur under any Account created for your use, even if such activities were not committed by you. Your Tiny Home is not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password.
Your Tiny Home employees, directors, managers, and their respective immediate family members (including parents, spouses, domestic partners, siblings, and children) or any other person residing in the same household as a Your Tiny Home employee, director, or manager may not win the offered giveaways.
TERMINATION OF ACCOUNT
Your Rights to Cancel
You may cancel your account and membership at any time by:
- logging in to your account on the Site;
- navigating to the “Membership” or “Account Settings” section;
- clicking the “Cancel Membership” or “Cancel Account” button; and
- following the prompts to confirm cancellation.

Effect of Cancellation
Upon cancelling your account:
- you will receive an email confirmation of the cancellation;
- you will be removed from all future recurring payments;
- you will forfeit any accumulated loyalty streak and associated benefits;
- you will forfeit any bonus contest entries attributable to loyalty membership;
- you will lose access to the member dashboard and Partner Offers at the end of your current paid period (for loyalty memberships) or immediately (for cancelled one-time packages);
- you will not receive a refund for the current billing period already paid; and
- any unused membership time will be forfeited.
Reactivation After Cancellation
- Once cancelled, your subscription cannot be reactivated through the payment processor;
- All accumulated history, loyalty streak, and bonus entries for that subscription will be permanently lost;
- To resume membership, you must create a new subscription through the Site;
- You may be able to synchronise your previous entry history if you create a new subscription within thirty (30) days of cancellation, provided there is no gap greater than thirty (30) days between your cancelled subscription and new subscription; and
- Synchronisation is not guaranteed and is at Your Tiny Home’s sole discretion.
Account Ownership
You acknowledge and agree that:
- you have no ownership rights in your account;
- your account is a license to access the Platform, which may be revoked;
- Your Tiny Home may cease offering the Service at any time without liability; and
- Your Tiny Home may cancel your account and delete all associated information at any time, with or without notice, for any reason including breach of these Terms.
Our Right to Terminate
Your Tiny Home may immediately suspend or terminate your account without notice if:
- you breach any provision of these Terms;
- you engage in fraudulent activity or provide false information;
- you engage in prohibited activities as defined in these Terms;
- your payment fails, and you do not rectify it within the grace period;
- you attempt to manipulate contests or giveaways;
- you interfere with the Platform or other users’ access;
- we reasonably suspect unlawful activity; or
- continuation of your account would pose a risk to Your Tiny Home, Partner, or other users.
Effect of Our Termination
If we terminate your account for cause:
- you will not receive any refund for unused membership time;
- you will immediately lose all access to the Platform and member benefits;
- you will forfeit all contest entries and loyalty benefits;
- you may be prohibited from creating a new account; and (e) we reserve the right to pursue legal action for damages.
Data Retention After Termination
- We may retain your personal information after account termination as required by law or for legitimate business purposes;
- We will handle your retained information in accordance with our Privacy Policy;
- You may request deletion of your personal information subject to our legal obligations; and
- Some information may remain in backup systems for a limited period.
Mailing Lists and Communications
- Cancelling your membership does not automatically remove you from marketing communications;
- Marketing communications are managed through third-party services;
- To unsubscribe from emails, use the “unsubscribe” link in any email communication;
- To unsubscribe from SMS, reply “STOP” or use the opt-out link provided;
- You may also manage communication preferences in your account settings before cancellation; and
- It may take up to ten (10) business days to process opt-out requests.
PROHIBITED ACTIVITIES
You agree that you will not, in connection with your use of the Site or Online Services, violate any applicable law or regulation.
Without limiting the foregoing, you agree not to:
- make available through the Site any material or information that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity);
- institute, assist, or become involved in any attack, including denial of service attacks, upon the Site or Online Services, or otherwise attempt to disrupt the Site, Online Services, or any other person’s use thereof; or
- attempt to gain unauthorised access to the Site, Online Services, Accounts registered to other users, or computer systems or networks connected to the Site or Online Services.
You may not use the Site to develop, generate, transmit, or store information that:
- is defamatory, derogatory, harmful, abusive, obscene, or hateful;
- obstructs or interferes with the normal performance of another person’s use of the Site or Online Services;
- performs any unsolicited commercial communication not permitted by applicable law;
- constitutes harassment or a violation of privacy, or threatens other people or groups;
- is harmful to children in any manner;
- violates any applicable law, regulation, or ordinance;
- makes any false, misleading, or deceptive statement or representation regarding Your Tiny Home, the Site, or Online Services; or
- constitutes phishing, pharming, impersonation, identity theft, or assumes any person’s identity (whether real or online alias).
You agree not to:
- obtain or attempt to obtain any information from the Site, including email information of other Account holders or software data;
- intercept, examine, or observe any proprietary communications protocol used by the Site or Software through network analysers, packet sniffers, or other devices; or
- use any bot, spider, virus, worm, software lock, Trojan horse, trap door, time bomb, or any other code or software designed to provide surreptitious or unauthorised access to, or to distort, delete, damage, or disassemble the Site or software.
INTELLECTUAL PROPERTY
The interfaces, content, arrangement, and layout of the Site, including the Your Tiny Home trademark, copyright material and logo, designs, text, artwork, graphics, images, buttons, user interfaces, information, and other content, and any compilation thereof (Your Tiny Home Intellectual Property) are:
- the property of Your Tiny Home, except where otherwise noted;
- protected from copying, imitation, communication, or simulation under Australian and international laws; and
- may not be reproduced, modified, communicated, displayed, distributed, or transmitted without the prior written permission of Your Tiny Home.
By visiting the Site, you do not acquire or obtain, by implication or otherwise, any licence or right to use or make additional copies of any materials or information displayed on the Site. You agree not to display or use any Your Tiny Home Intellectual Property or third-party content in any manner not expressly permitted under these terms and conditions.
When accessing the Site, you agree to obey the law and respect the intellectual property rights of others. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content in violation of any third party’s intellectual property or proprietary rights.
You shall be solely responsible for:
- any violations of relevant laws; and
- any infringements of third-party rights caused by any content you provide or transmit, or that is provided or transmitted using your account.
The burden of proving that any content does not violate any laws or third-party rights rests solely with you.
HYPERLINKS
The Site may contain links to websites operated by other parties. Your Tiny Home provides these links as a convenience, and use of these sites is at your own risk.
The linked sites are not under the control of Your Tiny Home, and Your Tiny Home:
- is not responsible for the content available on other sites;
- does not endorse information or material on any other site; and
- disclaims all liability with regard to your access to and use of such linked websites.
You may not place a link to the Site on another website without our prior written consent. Without limiting the foregoing, you must adhere to the following linking policy:
- the appearance, position, and other aspects of the link may not damage or dilute the goodwill associated with Your Tiny Home’s names and trademarks;
- the link may not create a false appearance that your organisation is Partner by, affiliated with, or associated with Your Tiny Home;
- when selected by a user, the link must display the Site on full-screen and not within a frame on the linking site; and
- Your Tiny Home reserves the right to revoke consent to the link at any time in its sole discretion.
PARTNER RELATIONSHIP AND TERMS
Partner Registration
- Your Tiny Home maintains Partnerships exclusively with registered and official Australian businesses;
- To become a Partner, businesses must complete an application at info@yourtinyhomeco.com.
- Partner applications are subject to approval at Your Tiny Home’s sole discretion;
- Partners must meet our eligibility criteria including valid ABN, appropriate licenses, and good business standing;
- We conduct due diligence on potential Partners but do not guarantee Partner performance; and
- We reserve the right to refuse any Partner application without providing reasons.
Partner Obligations
Partners listed on the Platform must:
- maintain valid business registration and all required licenses;
- honour all Partner Offers made available to members;
- clearly communicate terms, conditions, and restrictions applicable to offers;
- handle member transactions professionally and in accordance with consumer law;
- respond to member inquiries and complaints in a timely manner;
- maintain reasonable stock levels for advertised offers;
- notify us promptly of any changes to offers, availability, or business status;
- comply with all applicable Australian laws and regulations; and
- not engage in misleading, deceptive, or unlawful conduct.
Member Transactions with Partners
You acknowledge and agree that:
- when you access a Partner Offer, you enter into a direct transaction with that Partner;
- Your Tiny Home is not a party to your transaction with Partners;
- Your Tiny Home does not sell, supply, deliver, or warrant any Partner products or services;
- Partners are independent businesses responsible for their own products, services, and customer relationships;
- each Partner’s terms and conditions apply to your transaction with them;
- you must review and accept Partner terms before completing any transaction;
- payment for Partner products/services is made directly to the Partner (unless otherwise specified);
- Your Tiny Home does not handle payment processing or fulfilment for Partner transactions; and
- Your Tiny Home is not responsible for Partner performance or failure to perform.
Partner Offer Information
- Partner Offers displayed on the Platform are provided by Partners;
- We display Partner Offers in good faith based on information provided by Partners;

- Offers may change or be withdrawn by Partners at any time without notice to us or you;
- We do not guarantee the accuracy, completeness, or currency of Partner Offer information;
- Discount amounts are calculated by Partners and may vary;
- Some offers may have quantity limitations, time restrictions, or eligibility requirements; and
- You must verify offer details with the Partner before relying on any information.
Partner Performance Issues
If you experience issues with a Partner:
- you must first contact the Partner directly to attempt resolution;
- you may report Partner issues to us at info@yourtinyhomeco.com .
- we will review reported issues but cannot compel Partners to resolve disputes;
- we may investigate and take action including removing Partners from the Platform;
- we encourage you to also report serious issues to relevant consumer protection authorities; and
- we reserve the right to terminate Partner relationships at our discretion.
Partner Removal
We may remove a Partner from the Platform at any time if:
- the Partner breaches their agreement with us;
- we receive significant member complaints about the Partner;
- the Partner engages in misleading or unlawful conduct;
- the Partner fails to honour offers made to members;
- the Partner’s business registration or licenses lapse;
- the Partner requests removal; or
- we determine in our sole discretion that continuation of the partnership is not appropriate.
No Warranty for Partner Products or Services
Your Tiny Home makes no representations or warranties regarding:
- the quality, safety, legality, or suitability of Partner products or services;
- Partner business practices or compliance with laws;
- the accuracy of Partner Offer descriptions or terms;
- Partner ability to fulfil orders or deliver products/services;
- Partner customer service or dispute resolution; or
- any aspect of your transaction with Partners.
Partner Data Sharing
- When you access a Partner Offer, we may share your contact information and transaction details with the relevant Partner;
- Partners may use your information to fulfil offers, provide customer service, and for their own marketing purposes;
- Partner use of your information is governed by their privacy policy, not ours;
- We are not responsible for Partner handling or misuse of your information;
- You consent to this data sharing when you access Partner Offers; and
- You may contact Partners directly to manage your information preferences with them.
Commission and Fees
- Your Tiny Home may receive commissions, fees, or other consideration from Partners;
- These commercial arrangements do not affect the price you pay for Partner products or services;
- Commission arrangements may influence which Partners or offers are featured;
- We aim to present offers that provide value to members regardless of commission rates; and
- Members do not pay any additional fees to access Partner Offers beyond their membership fees.
Complaints About Partners
To report a Partner issue:
- email us at info@yourtinyhomeco.com with:
- Partner name and details;
- description of the issue;
- relevant dates and transaction information; and
- copies of communications or evidence.
- we will acknowledge your complaint within five (5) business days;
- we will review the complaint and may contact you or the Partner for additional information;
- we will take appropriate action which may include mediation, Partner warnings, or Partner removal; and
- we will notify you of the outcome where appropriate.
Partner Insolvency or Closure
- If a Partner ceases business, becomes insolvent, or closes:
- outstanding Partner Offers may no longer be honoured
- we will remove the Partner from the Platform as soon as practicable
- we are not responsible for honouring the Partner’s obligations
- you may have rights against the Partner under consumer law
- We recommend acting promptly on any Partner Offers you wish to use.
COMPETITORS ARE EXCLUDED
You are not allowed under any circumstances to use or access any documents or content on our Site in any way that competes with our business. Your Tiny Home reserves its right to exclude and not permit any person using this Site or accessing its document in its sole discretion.
WARRANTIES AND DISCLAIMERS
This Site and our Online Services are provided on an “as is” and “as available” basis and to the fullest extent permitted by law we make no representations, guarantees or warranties of any kind about our Site and/or the Online Services including that:
- they are suitable, reliable, complete, secure, accurate or fit for any particular purpose;
- access will be free of any harmful components (including viruses) or other code that is harmful or may assist in causing harm; or
- there is no possibility of failure to store communications or other data.
The member represents and warrants that they shall not contact any affiliate, employee, Partner, or partner of Your Tiny Home in order to manipulate contest results.
SERVICE AVAILABILITY AND SUPPORT
- The Site and Services are provided “as is” and “as available” without guarantee of uninterrupted or error-free access. No credits or refunds for temporary unavailability;
- Scheduled maintenance will have 24 hours’ notice where possible (posted on Site and via email), typically during off-peak hours. Emergency maintenance may occur without notice;
- We are not responsible for: your internet, device, or browser issues; compatibility problems; third-party service failures; or force majeure events (natural disasters, war, pandemics, government actions, cyberattacks, power outages, labour disputes);
- We provide support for account access, password resets, payments, Site functionality, and membership management. We do not support third-party products, Partner issues (contact Partners directly), or general computer/internet technical support;
- Contact support at info@yourtinyhomeco.com or http://www.yourtinyhomeco.com/contact with detailed issue description, error messages, steps taken, device/browser info, and screenshots. Response within two (2) business days (Monday-Friday, 9 AM-5 PM AEST, excluding public holidays);
- System requirements: compatible device, internet connection, current browser (Chrome, Firefox, Safari, Edge), JavaScript and cookies enabled, valid email address; and
- During force majeure events, we will use reasonable efforts to minimize disruption and resume operations as soon as practicable.
CONSUMER LAW RIGHTS
- Nothing in these Terms excludes, restricts, or modifies your Australian Consumer Law (ACL) or consumer protection rights.
- ACL guarantees for services: rendered with due care and skill, fit for specified purpose, delivered within reasonable time. For goods: acceptable quality, fit for purpose, match description/sample;
- ACL distinguishes major and minor failures with different remedies (see Refunds section);
- To the extent permitted by law, our liability for non-excludable guarantees is limited to:
- (for services) re-supplying services or paying re-supply cost;
- (for goods) replacement, repair, or payment of replacement/repair cost.
(e) The liability limitations in these Terms do not apply to liability that cannot be excluded under ACL..
MORE LIMITATIONS ON LIABILITY
The disclaimers of liability outlined in any of these terms and conditions apply to all customers, clients or visitors.
We otherwise do not accept any liability for any loss, damage, costs or expenses including legal costs and expenses (direct or indirect) incurred by you in connection with the use of this Site or the Online Services.
GIVEAWAYS
General Giveaway Terms
By becoming a member and participating in any giveaway or contest (Giveaway):
- you agree to be bound by these Terms, the Privacy Policy, Membership Terms and Conditions, Giveaway Terms and Conditions and any specific terms or rules published on the Site from time to time;
- you must be aged 18 years or over and a resident of Australia;
- you must reside within the Exclusive Locations;
- you must be a current member in good standing with no outstanding payment issues;
- entry is free and automatic upon maintaining an active membership unless otherwise specified
- additional entries may be earned through loyalty membership duration and other promotional activities; and
- all entry and prize information will be available on the Giveaway page or in your member dashboard.
Eligibility Restrictions
The following persons are not eligible to participate in Contests:
- employees, directors, and managers of Your Tiny Home;
- any person residing outside of the Exclusive Locations;
- immediate family members of Your Tiny Home employees, directors, or managers (including parents, spouses, domestic partners, siblings, and children);
- any person residing in the same household as a Your Tiny Home employee, director, or manager;
- Partners and their employees (for Giveaway’s involving that Partner’s products);
- persons who have been banned or suspended from the Platform; and
- persons who have previously been disqualified from a Giveaway.
Winner Selection and Notification
- Winners will be selected by random draw unless otherwise specified;
- The draw will occur on or around the date specified for each Giveaway;
- Winners will be notified by email and/or phone within seven (7) days of the draw;
- Winners must respond and claim their prize within fourteen (14) days of notification;
- If a winner does not respond within the claim period, the prize may be forfeited and a new winner selected; and
- Winner names may be published on the Site (for at least the minimum period of 28 days) or social media (with winner consent).
Prize Details
- Prize details, including value and specifications, will be published for each Giveaway;
- Prizes are not transferable, exchangeable, or redeemable for cash unless otherwise stated;
- If a prize is unavailable, we reserve the right to substitute a prize of equal or greater value;
- Prize values are based on recommended retail prices and may vary;
- Winners are responsible for any costs not specifically included in the prize description; and
- Winners may be required to sign a prize acceptance form and release.
Prize Delivery
- Prizes will be delivered within twenty-eight (28) days unless:
- varied by Your Tiny Home and accepted by you; or
- Your Tiny Home, acting reasonably and making all reasonable efforts, is unable to deliver it within the timeframe required. Upon such instance, Your Tiny Home, will provide you with estimate delivery date and the basis for the delay.
- Delivery is included to residential addresses within Queensland, New South Wales, and Victoria only. Sites must be accessible by a standard delivery truck (no cranes, ferries, or island deliveries).
- Winners are responsible for providing accurate delivery information;
- We are not responsible for prizes lost, stolen, or damaged in transit;
- Delivery timeframes are estimates and may be affected by factors beyond our control; and
- Some prizes may require winner collection or attendance at a specific location.
- Cash prizes will generally be paid via electronic transfer to the winner’s nominated Australian bank account within five (5) business days of winner verification.
Permit and Regulatory Compliance
- Giveaways are conducted in accordance with relevant regulations in:
- Australia; and
- the Exclusive Locations.
- Where required, appropriate permits have been obtained;
- Giveaway rules are available on request;
- Giveaways are void where prohibited by law; and
- We reserve the right to cancel or modify any Giveaway to comply with legal requirements.
Prohibited Conduct
Participants must not:
- tamper with or attempt to manipulate the Giveaway entry process;
- use automated systems, bots, or scripts to generate entries;
- create multiple accounts to gain additional entries;
- contact Partners, Partners, or affiliates to influence Giveaway results;
- engage in fraudulent or deceptive conduct;
- interfere with other participants’ ability to enter; or
- violate any Contest rules or these Terms.
Disqualification
Your Tiny Home reserves the right to disqualify any participant who:
- engages in any prohibited conduct;
- violates Giveaway rules or these Terms;
- provides false or misleading information;
- is found to be ineligible;
- fails to comply with winner verification requirements; or
- engages in conduct that is unfair, abusive, or contrary to the spirit of the Giveaway.
Disqualification decisions are final and made at our sole discretion.
Limitation of Liability for Giveaway
By participating in any Giveaway, you acknowledge and agree that:
- any disputes, claims, and causes of action arising from the Giveaway shall be resolved individually without class action;
- any claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred in entering the Giveaway;
- under no circumstances will Your Tiny Home be responsible for legal fees, punitive damages, or consequential damages;
- you waive all rights to claim aggravated, incidental, or consequential damages; and
- you waive all rights to have damages multiplied or increased.
Giveaway Modification or Cancellation
Your Tiny Home reserves the right to:
- suspend, modify, or cancel any Giveaway if it is compromised by unauthorised intervention, tampering, technical failures, or other causes beyond our reasonable control;
- disqualify entries that do not comply with Giveaway rules;
- modify Giveaway rules or Terms at any time;
- substitute prizes of equal or greater value if circumstances require.
Technical Issues
Your Tiny Home assumes no responsibility for:
- technical malfunctions of computer systems, servers, or internet service providers;
- failure of entries to be received due to technical problems, congestion, or failures;
- incomplete, late, lost, damaged, illegible, or misdirected entries or communications;
- unauthorised human intervention or technical errors affecting Giveaway integrity; or
- any injury or damage to participant’s or any other person’s computer relating to or resulting from participation.
Tax Implications
- Prize values may have tax implications for winners;
- Winners are responsible for any applicable taxes on prizes (where applicable);
- Winners may be required to provide tax file numbers or other information for reporting purposes; and
- We recommend winners consult with a tax professional regarding tax obligations.
Publicity Release
By accepting a prize, winners consent to:
- Your Tiny Home using their name, image, and likeness for promotional purposes;
- participation in reasonable promotional activities;
- publication of winner information on the Site (for at least the minimum period of 28 days) and social media; and
- testimonials or interviews about their prize experience.
Winners may decline publicity participation, but this may affect prize eligibility for certain Giveaways where publicity is a condition of entry.
DISPUTE RESOLUTION
- First contact us at info@yourtinyhome.com or www.yourtinyhomeco.com/contact with: account details, complaint description, relevant dates/transactions, supporting documents, and desired resolution. We acknowledge within five (5) business days and respond within fourteen (14) business days;
- If unresolved, request escalation to senior management for review (response within further 14 business days with final position statement);
- Both parties bear own costs unless ordered otherwise. Before legal proceedings, parties agree to attempt good faith negotiation and may propose mediation (costs shared equally, voluntary, confidential);
- Legal proceedings must be in Queensland courts under Queensland/Australian law. You submit to non-exclusive jurisdiction of Queensland courts. Complaints should be made promptly.
- For Giveaway disputes, individual resolution without class actions required (see Giveaways section), but this doesn’t prevent participation in class actions for consumer law claims or statutory rights; and
- We maintain complaint records. You should retain all correspondence and evidence for potential proceedings.
INDEMNITY
You hereby indemnify Your Tiny Home and any associated party and undertake to keep us indemnified next to any losses, loss, costs, liabilities and bills (including without restriction legal expenses and also any amounts compensated by us to a third party in settlement of an claim or dispute) sustained or suffered arising from any breach of any provision of these Terms, or arising from any claim that you have breached any supply of these Terms.
BREACHES OF THESE TERMS AND CONDITIONS
Without prejudice to our other rights, if you breach these terms and conditions of use at all, or if we reasonably suspect that you have breached these terms and conditions of use at all, we may:
- send you more than one formal warnings;
- temporarily suspend your having access to Site;
- permanently restrict you from accessing the Site;
- block computers with your IP address from accessing the Site;
- contact your online services provider and request they block your having access to the Site;
- bring court proceedings against an individual for breach of contract or otherwise;
- suspend and/or erase your account with the Site; and/or
- erase and/or edit any or all of your current content.
Where we postpone or prohibit or block your having access to the Site or a component of the Site, you must not take any activity to circumvent such suspension or prohibition or perhaps blocking (including without having limitation creating and/or having a different account).
VARIANCE
- We may revise these Terms at any time, with the “Last Updated” date and version number updated accordingly;
- For material changes (refund policies, pricing, member rights, liability terms, or data practices), we will provide at least fourteen (14) days’ notice via email, Site notice, or dashboard notification;
- Non-material changes (clarifications, corrections) may be made without notice;
- Revised Terms take effect upon posting unless otherwise specified;
- Your continued use after revision constitutes acceptance;
- If you disagree with revised Terms, you must cancel your membership before the effective date (no refund for remaining time);
- Previous versions are available upon request and retained for two (2) years;
- We will notify you of Platform changes, Partner updates, pricing changes, Contests, maintenance, and account issues via email, dashboard notifications, SMS (if consented), or Site notices; and
- You must maintain a current email address, check emails regularly (including spam folders), and notify us of any changes.
ASSIGNMENT
You hereby agree that you may not transfer, sub-contract or otherwise deal with any or our rights and/or requirements under these conditions. You may certainly not transfer, sub-contract or otherwise cope with your rights and/or requirements under these conditions without obtaining your prior written agreement.
SEVERABILITY
If any of these Terms is determined through any court or other competent authority to be unlawful and/or unenforceable, the remainder provisions will continue in effect.
EXCLUSION OF ALTERNATIVE RIGHTS
Subject to this preceding paragraph, these Terms are for the benefit of you and are not meant to benefit any alternative or be enforceable by any alternative. The exercise individuals and your rights with regards to these terms and conditions is just not subject to this consent of any alternative.
ENTIRE UNDERSTANDING
These Terms, together with our Privacy Policy and Member Terms, constitute the overall agreement between an individual and us with regards to your use of the Site, and supersede almost all previous agreements in respect of your use of the Site.
